1. Acceptance of Terms

By downloading, installing, or using SensePose ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

SensePose is an AI-powered photography application that provides intelligent exposure optimization, composition guidance, neural upscaling, and automatic post-editing features. The App may include cloud-based processing services that enhance your photos using artificial intelligence.

3. User Accounts

To use certain features of the App, you may need to create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

We reserve the right to terminate accounts that violate these Terms or for any reason at our sole discretion.

4. User Content

You retain ownership of photos and content you create or upload to the App ("User Content"). By using the App, you grant us a limited, non-exclusive license to process your User Content solely for the purpose of providing our services.

You represent and warrant that:

  • You own or have the rights to use all User Content you submit
  • Your User Content does not infringe the rights of any third party
  • Your User Content complies with these Terms and all applicable laws

5. Prohibited Uses

You agree not to use the App to:

  • Violate any applicable laws, regulations, or third-party rights
  • Upload or transmit viruses, malware, or other harmful code
  • Attempt to gain unauthorized access to the App or its systems
  • Interfere with or disrupt the App's operation
  • Create accounts through automated means or under false pretenses
  • Collect or store personal data about other users without their consent
  • Use the App for any illegal or unauthorized purpose

6. Subscription and Payments

The App offers both free and premium (Pro) features. Premium features require a paid subscription. By subscribing, you agree to:

  • Pay all applicable fees in accordance with the pricing displayed
  • Provide valid payment information
  • Authorize us to charge your payment method for subscription renewals
  • Understand that subscriptions automatically renew unless cancelled

You can cancel your subscription at any time through your account settings or the app store where you made the purchase. Refunds are subject to the refund policies of the respective app store.

7. Intellectual Property

The App, including all content, features, and functionality, is owned by Profazia and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

The SensePose name, logo, and all related marks are trademarks of Profazia. You may not use these marks without our prior written permission.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PROFARIA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR USE OF OR INABILITY TO USE THE APP
  • ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS
  • ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE APP
  • ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH THE APP
  • ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT

10. Indemnification

You agree to indemnify, defend, and hold harmless Profazia and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your User Content

11. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the App will immediately cease.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Profazia is based, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the App after such changes constitutes acceptance of the new Terms.
