Terms of Service

1. Acceptance of Terms

By downloading, installing, or using SensePose ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

SensePose is developed and operated by Profazia ("we", "us"), the trading name of an independent solo developer based in India. Paid subscriptions are sold by Dodo Payments as Merchant of Record, not by us directly — see section 6.

2. Description of Service

SensePose is a pro camera application that provides a real-time Pro Mode (manual and adaptive control of ISO, EV, aperture and shutter), RAW HDR+ multi-frame burst capture and merging, neural upscaling, and automatic tone grading. The App also records video with audio. The App may include cloud-based processing services that enhance your photos using artificial intelligence.

3. User Accounts

To use certain features of the App, you may need to create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to terminate accounts that violate these Terms or for any reason at our sole discretion.

4. User Content

You retain ownership of photos and content you create or upload to the App ("User Content"). By using the App, you grant us a limited, non-exclusive license to process your User Content solely for the purpose of providing our services.

You represent and warrant that:

• You own or have the rights to use all User Content you submit
• Your User Content does not infringe the rights of any third party
• Your User Content complies with these Terms and all applicable laws

5. Prohibited Uses

You agree not to use the App to:

• Violate any applicable laws, regulations, or third-party rights
• Upload or transmit viruses, malware, or other harmful code
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's operation
• Create accounts through automated means or under false pretenses
• Collect or store personal data about other users without their consent
• Use the App for any illegal or unauthorized purpose

6. Subscription and Payments

The App offers both free and premium (Pro) features. Premium features require a paid subscription. By subscribing, you agree to:

• Pay all applicable fees in accordance with the pricing displayed
• Provide valid payment information
• Authorize us to charge your payment method for subscription renewals
• Understand that subscriptions automatically renew unless cancelled

Pro subscriptions are sold through Dodo Payments, which acts as the Merchant of Record and appears on your card or bank statement. Pro is not sold through Google Play Billing, so the Play Store subscription screen cannot cancel or refund it.

You can cancel at any time from Profile → Subscription → Manage in the App, which opens the billing portal, or by emailing support@profazia.com from the address on your account. Cancelling stops future renewals; Pro stays active until the end of the period you have already paid for.

Refunds are governed by our Refund & Cancellation Policy, which forms part of these Terms. In summary, we refund a charge in full if you ask within 2 days and have used no more than 5 cloud enhancements in that billing period. Consumers in the EU, EEA and UK have a separate statutory right of withdrawal, described in that policy.

Prices vary by country and are shown to you before checkout. We may change subscription pricing, but a change will never affect a period you have already paid for, and we will give you notice before it applies to a renewal.

7. Intellectual Property

The App, including all content, features, and functionality, is owned by Profazia and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

The SensePose name, logo, and all related marks are trademarks of Profazia. You may not use these marks without our prior written permission.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PROFAZIA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR USE OF OR INABILITY TO USE THE APP
• ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS
• ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE APP
• ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH THE APP
• ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT
• ANY LOSS OF, OR DAMAGE TO, PHOTOGRAPHS, VIDEOS OR OTHER FILES ON YOUR DEVICE

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD 50.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited. If you are a consumer, these limits apply only so far as your local consumer law allows, and your statutory rights are unaffected.

10. Indemnification

You agree to indemnify, defend, and hold harmless Profazia, and anyone acting on our behalf, from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content

11. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the App will immediately cease.

12. Governing Law

Profazia is an independent developer based in India. These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions, and the courts of India shall have jurisdiction over any dispute arising out of them.

If you are a consumer, this does not deprive you of the protection of mandatory consumer-law provisions in your country of residence, and you may bring proceedings in your local courts where the law gives you that right.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the App after such changes constitutes acceptance of the new Terms.
